Contact: support@sparkhop.app
Website: https://sparkhop.app

These Terms of Use govern your access to and use of Sparkhop (the “App”) and related services. The service is provided by Rakhat Zhumaev (“we”, “us”, “our”), an individual developer; there is no company behind it yet. If the service moves to a company, we will tell you in the App before the change.

1. Acceptance

By creating an account or continuing to use the service, you accept these Terms. Our Privacy Policy explains how we handle your data. You must be at least 13 years old to use Sparkhop, or older where the law of your country sets a higher age for agreeing to the processing of your personal data.

2. Accounts

You can browse public content without an account. Creating or changing anything requires signing in with Apple or Google.

You are responsible for:

  • keeping your credentials secure,
  • ensuring information you provide is accurate,
  • all activity under your account.

We may suspend or terminate accounts for abuse, fraud, illegal activity, policy violations, or security reasons.

3. Wishlist content

You may create, save, like, and share lists and wishes. You are responsible for content you submit. You must have the right to upload any photo you attach.

You must not submit content that is:

  • illegal,
  • deceptive,
  • infringing,
  • harassing,
  • hateful,
  • obscene,
  • spam,
  • malware,
  • doxxing or privacy-invasive,
  • otherwise harmful or abusive.

4. Quick adds, likes, and saved data

Quick adds are temporary capture records. Likes are user actions on content. Saved feeds may combine multiple content sources.

We may process, transform, or delete this data as part of normal service operation, moderation, retention rules described in the Privacy Policy, or account deletion.

5. Shared lists, family groups, event lists and purchase marks

  • Shared lists. A list owner can share a list with other people with a role (for example view or edit). People with edit rights may change what the role allows; the owner can change or remove access at any time. You are responsible for whom you invite.
  • “For an event” lists. A list may have an event date shown to people who can see the list.
  • Purchase marks. People who can see a list may mark a wish as reserved or bought so that others do not buy the same gift. By default the list owner is not told that a wish was bought or by whom; the list’s settings and the buyer’s choice decide what the owner may learn. A mark is information shared among gift-givers, not a purchase or a contract with us, and we do not sell, deliver or guarantee any product.
  • Links and prices. Product details and prices are read from third-party websites and may be outdated or wrong. Price tracking and notifications are provided on a best-effort basis; check the store before you buy.

6. Import from links

You may import lists and products from a link only if you are entitled to use the content for your own personal use. Imported content must still comply with section 3. Imported material is checked like any other content (section 8). Do not import pages that require you to share credentials or content that you do not have the right to copy.

7. Plus and Plus Family subscriptions

What it is. Plus and Plus Family are optional paid subscriptions that unlock additional features, for example a higher list limit and public lists that others can open and find. Features and limits are described in the App before you subscribe and may change; we will not remove a feature you have already paid for during the current paid period.

Purchase through the store. Subscriptions are sold only through the Apple App Store or Google Play and processed by the store, with paywalls and purchase events handled for us by Superwall. The plan names, price, billing period, currency and any free trial are shown in the App and in the store before you confirm; taxes may apply. We do not receive your payment details.

Free trial. Where a free trial is offered, its length is shown before you subscribe. If you do not cancel at least 24 hours before the trial ends, the store will charge the displayed price and the subscription renews. A trial can be used once per store account where the store allows it.

Automatic renewal. Subscriptions renew automatically for the same period at the then-current price until cancelled. Your store account is charged at confirmation of purchase (or at the end of a free trial) and within 24 hours before each renewal. We will tell you about a price change as required by the store and applicable law; if you do not accept it, cancel before the renewal.

How to cancel. Cancel in the store, not in the App: on iPhone, Settings > your name > Subscriptions; on Android, Google Play > Payments & subscriptions > Subscriptions. The App’s settings link to these pages. Cancelling stops future renewals; you keep Plus until the end of the period already paid. Deleting the App or your account does not cancel a subscription.

Refunds and withdrawal. Refunds are handled by Apple or Google under their policies; we cannot issue refunds for store purchases. If you live in the European Union or the United Kingdom, you may have a legal right to withdraw from a purchase within 14 days; for a purchase made through Apple or Google, you use that right through the store’s refund process. If a purchase is refunded or reversed by the store, we may withdraw the corresponding access.

Restoring purchases. “Restore purchases” in the App re-links your store subscription to your account. A store subscription can be linked to only one account in the App: Plus is granted to the first account that it was linked to. Apple Family Sharing and equivalent store sharing are not used.

Plus Family. Plus Family is bought by the owner of a family group in the App (a person who is not in a family becomes the owner of a new one when buying).

  • The family has up to 6 members including the owner. The owner pays and the owner’s subscription is the only one that is charged.
  • Every member of the family has Plus features while the owner’s Plus Family subscription is active and they remain members; each member gets their own usage limits for AI-assisted features.
  • A member removed from the family, or who leaves it, loses Plus access from family immediately. Members keep the content they have created.
  • If the owner dissolves the family, or the owner’s subscription ends or is cancelled and expires, members lose Plus access from the family at once; the subscription itself remains with, and is managed by, the person who paid.
  • A member who also has their own personal subscription keeps it and can cancel it in the store; we do not cancel it for them.
  • To prevent resale of seats, a person who leaves a family must wait 30 days before joining a different one. Creating your own family is not limited.
  • The only owner of a family cannot simply leave it while other members remain; they can first make another member an owner, or dissolve the family.
  • If the owner deletes their account and other members remain, the member who joined first becomes the owner; a family with no other member is deleted with the account.

Store terms. Your purchase is also subject to the store’s terms. For Apple App Store purchases, Apple’s standard Licensed Application End User License Agreement applies together with these Terms; for Google Play, the Google Play Terms of Service apply. Apple and Google are not responsible for the App or its support.

8. User-generated content moderation

Content you post is checked automatically before other people see it (see the Privacy Policy and the Content and Moderation Policy). You see your own content at once; everybody else, including the people you share a list with, sees new or changed text and photos after the check approves it. A photo that the check rejects is rejected in every wish that holds the same image address. We may remove content, restrict visibility, suspend accounts, or take other actions if content or behavior violates these Terms or our moderation policy. No human reviews content as part of the standard process. If your content is rejected, you may edit it or appeal once. If you disagree with the result of the appeal, write to support@sparkhop.app and a person will look at it.

18+ content. Content for adults only (for example adult products) is rated 18+ and is hidden by default. It is shown to other people only if they are at least 18, have turned on “Show 18+” in their settings after confirming their age and giving a separate consent, and only inside a list they opened on purpose; it is never recommended and never shown to visitors who are not signed in. You must not turn the setting on if you are under 18 and must give truthful age information; giving false age information breaks these Terms and may lead to the suspension of your account. If an age under 18 is reported or entered, the setting stays locked for your account. On iOS the setting is turned on on our website, not in the app. Explicit nudity, pornography, intimate services, anything involving minors and links to paid adult-content platforms are not allowed at all (see the Content and Moderation Policy).

9. Third-party services

The service relies on third-party services for authentication, hosting, AI processing, subscriptions, push notifications and diagnostics. They are listed in the Privacy Policy and are subject to their own terms and privacy policies. Links to third-party websites are not under our control.

10. Intellectual property

We own the service, branding, and software except for open-source components and user content as otherwise provided by law or separate agreement. You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, process and display your content only as needed to operate and improve the service, including showing it to the people you choose to share it with. The licence ends when you delete the content or your account, except for copies we must keep by law (see the Privacy Policy).

11. Disclaimers

The service is provided “as is” and “as available” to the extent permitted by law.

We do not guarantee uninterrupted availability, error-free operation, the accuracy of prices and product information, the accuracy of automated checks, or that all content will remain available.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, and nothing affects your statutory rights as a consumer.

13. Termination

You may stop using the service and delete your account at any time. We may suspend or terminate access at any time for the reasons described above.

14. Changes

We may change these Terms; we will update the effective date and, for material changes, notify you in the App before they take effect.

15. Governing law and disputes

These Terms are governed by the laws of Georgia, and the courts of Tbilisi, Georgia, have jurisdiction over disputes about them.

If you are a consumer living in the European Union or the United Kingdom, you also keep the protection of the mandatory rules of the law of the country where you live, and you may bring a claim in the courts of that country. The same applies wherever the law of your country gives consumers rights that a choice of law or court cannot take away.

16. Contact

Questions about these Terms: support@sparkhop.app. Privacy requests: privacy@sparkhop.app. support@sparkhop.app is also our single point of contact for users and for authorities under the EU Digital Services Act (Articles 11 and 12); we answer in English or Russian.
